Tesco International Calling Cards Terms & Conditions

These Terms & Conditions set out the terms under which Tesco Ireland Limited ("Tesco"), provides you with the ability to make calls using Tesco's pre-paid phone cards ("Tesco Calling Card Services").

References to "we", "us" and "our" are to Tesco and we refer to you as "you" and "your".

Please read these Terms & Conditions carefully as they affect your rights and liabilities under the law and the terms governing your use of Tesco's international calling cards ("Tesco Calling Cards").

In these Terms & Conditions some words begin with capital letters because they are definitions. See paragraph 11 for a list of these words and which paragraphs to go to in the Terms & Conditions to look up their meaning.

1. WHAT ARE TESCO CALLING CARDS?

1.1 Tesco Calling Cards are pre-paid phone cards which enable you to make national and international phone calls from landlines, mobile phones and payphones.

1.2 Tesco Calling Cards come in a variety of monetary values ("Credits"). Please see the FAQs for the details of the top-up amounts we currently offer.

2. VALIDITY PERIOD

2.1 Your Tesco Calling Card is valid for 90 days from date of that you purchase it ("Validity Period"). However, if you re-charge your Tesco Calling Card within the Validity Period, the 90 days will re-start from the date of recharge. You can re-charge your Tesco Calling Card as many times as you like.

2.2 Please note that, after the Validity Period, you will lose any remaining Credit on your Tesco Calling Card.

3. CALL RATES

3.1 Each time you use your Tesco Calling Card, the Credit on your Tesco Calling Card will be reduced by the charges incurred, calculated by Tesco using the call rates for Tesco Calling Cards ("Call Rates").
3.2 All calls using a Tesco Calling Card are charged in one minute increments, rounded up to the nearest minute. In addition, some calls (for example, calls using the 1800 access number or from a payphone) have a surcharge; for details of all surcharges please see our FAQs.
3.3 We will not charge you for calling our geographic access number (01 437 0050). However, you may incur charges from your phone service provider so please contact them to check whether this is the case and, if so, familiarise yourself with the charges which apply.
3.4 Call Rates are subject to change at any time.
3.5 Every effort is made to ensure that Call Rates are correct and up to date. Please check the Call Rates for the most up to date rates before you make a call as you will be charged at the then current rates listed at the time you make your call.
3.6 All Call Rates include VAT.

4. NO REFUND

4.1 If your Tesco Calling Card is lost, stolen, damaged or destroyed (and you do not know the PIN) you will lose any remaining Credit on the Tesco Calling Card. If your Tesco Calling Card is used in an unauthorised manner, we are not able to provide you with a refund of any Credit used in such manner.
4.2 In addition, as stated in paragraph 2.2 above, you will lose any remaining Credit on your Tesco Calling Card after the Validity Period expires.
5. RESTRICTIONS

You cannot use your Tesco Calling Card for calling premium rate numbers or some non-geographic numbers (for example, numbers beginning1550).

6. AVAILABILITY OF SERVICES

When we provide you with the Tesco Calling Card Services, we will use the reasonable skill and care of a competent service provider, but we cannot guarantee that the Tesco Calling Card Services will always be fault-free. Some things will be out of our control, for example, Tesco Calling Card Services are dependent on network operators and the services of such network operators can be affected by things that we cannot control.

7. OUR RESPONSIBILITY TO YOU

7.1 Nothing in this paragraph 7 shall limit or affect our liability resulting from anything we provide to you being found to be unsafe or if something we do negligently causes death or personal injury.
7.2 Subject to paragraph 7.1, if we are in breach of these Terms & Conditions, we will only be responsible for any losses that you suffer as a result to the extent that they are a foreseeable consequence to both of us at the time you buy the Tesco Calling Card, up to the price you paid for your Tesco Calling Card.
7.3 You acknowledge that we are not responsible for providing (or maintaining) the equipment that you use to access the Tesco Calling Card Services or the national or international telecommunications networks which your calls travel across.
7.4 Nothing in these Terms & Conditions affects your statutory rights (which include, for example, that we will provide the Tesco Calling Card Services to a reasonable standard and within a reasonable time).

8. YOUR RESPONSIBILITY TO US

8.1 You must not use your Tesco Calling Card for any unlawful or fraudulent purpose, to make any communication which is, or is intended to be, malicious, fraudulent or hoax (including to the emergency services) or in any way which may damage or affect the operation of the Tesco Calling Card Services or any other telecommunications system.
8.2 If you do not comply with this paragraph 8, your use of the Tesco Calling Card Services may be suspended indefinitely and you will compensate us for all liabilities, claims, damages, losses and costs (including legal costs) which we may suffer as a result.

9. GENERAL

9.1 If you give your Tesco Calling Card to another person they will be subject to these Terms & Conditions. We may transfer our rights under these Terms & Conditions to another business where we reasonably believe your rights will not be affected.
9.2 If you breach these Terms & Conditions and we do not immediately enforce our rights, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach these Terms & Conditions.
9.3 We shall not be responsible for any breach of these Terms & Conditions caused by circumstances beyond our reasonable control.
9.4 These Terms & Conditions are subject to the laws of the Republic of Ireland. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so in the Republic of Ireland, England, Scotland, Wales or Northern Ireland.
